How Long Does a Patent Application Take? Search, Examination and Registration Stages

Published

How long a patent application will take is a common question. However, the duration varies with the nature of the file, the speed of the applicant's responses, the workload of the examination and any objections, so no standard number of days is given.

Generally, it helps to think of the process in these stages:

  • Filing and formal check: the file is checked for completeness and compliance with formal requirements.
  • Search: a search comparing the invention with the prior art is carried out and a search report is prepared.
  • Examination: novelty, inventive step and industrial applicability are assessed.
  • Responses to deficiencies and objections: the applicant may be asked for explanations or amendments to the claims, and the replies at this stage directly affect the process.
  • Registration and publication: if the requirements are met, the registration is carried out and the record is published.

The duration of each stage may differ. Applicants are therefore advised to plan with the possibility of delays in mind. The protection term is counted from the filing date, not from the registration date: the longer registration takes, the shorter the remaining protection period from the grant, although the 20-year term runs from the filing date. The statutory term is subject to the requirements for maintaining the right.

Factors that may lengthen the process include rewriting of claims, insufficient explanation of the technical effect, and objections based on similarity to the prior art. A refusal is always possible, and it depends on the content of the file as well as on time.

The 12-month priority right under the Paris Convention is also important for timing. From the first filing date, the same invention can be filed in other countries within 12 months for patents, and that date is preserved. This period should not be confused with the national examination timeline.

For practical tracking, keep separate lists for technical preparation, official correspondence and the commercial timetable. Tell the person preparing the application early about a planned product launch. Drawings sent to manufacturers, investor presentations and website announcements belong in the same plan. When an official communication arrives, record the requested action and who will prepare the response, as well as the receipt date. A task waiting for information differs from a response already submitted. This distinction reduces last-minute requests for missing technical details. Flag features developed during preparation separately: handling a solution absent from the initial file requires a case-specific assessment.
